This notice explains how we handle the personal data of historical customers and visitors in the EU/EEA and the UK under the EU General Data Protection Regulation (GDPR) and the UK GDPR.

1) Important Update: Territorial Limitations & Cessation of Service

Effective July 1, 2026, Gay Jock Underwear L.L.C. has permanently ceased all marketing, sales, and shipping services to destinations within the European Union (EU), the European Economic Area (EEA), and the United Kingdom (UK). We have completely deactivated consumer checkout capabilities for these regions on our e-commerce platform.

This policy notice remains active solely to outline how we process the personal data of historical customers who placed orders prior to July 1, 2026, and to address casual web traffic from visitors residing in these territories. We do not intentionally target, market to, or collect ongoing personal data from individuals in the EU, EEA, or UK for commercial or behavioral targeting purposes.

3) Purposes & Legal Bases for Historical Data

  • Contract (Art. 6(1)(b) GDPR / UK GDPR): Historical order processing, financial payments, shipping fulfillment, and legacy customer support.
  • Legitimate interests (Art. 6(1)(f)): Essential site operation, fraud prevention, basic security, and geographic verification analytics.
  • Consent (Art. 6(1)(a)): Essential cookie/consent tracking preferences; you can withdraw at any time.
  • Legal obligations (Art. 6(1)(c)): Tax, legal compliance, business accounting, and statutory record-keeping.
  • Automated Decision-Making (AI): We utilize limited automated security filters for fraud prevention. You have the right to request human intervention if an automated decision affects your legal rights.

4) Categories of Data (Historical)

  • Contact & order details (name, email, phone, addresses, items, totals); payment metadata (handled securely by payment providers; we do not store full card numbers).
  • Account & support (login, preferences, legacy customer messages).
  • Technical/usage (IP address geographic checks, device/browser info, essential cookies, logs).
  • Withdrawal Request Data: For historical processing, when an EU/UK customer exercises their right of withdrawal, we collect the name, email address, and order details provided through our electronic withdrawal interface to process the request, verify the order, and comply with legal statutory obligations.

5) Recipients (Processors & Third Parties)

We use trusted service providers (e-commerce hosting, payment processors, fraud/security tools, basic analytics, and archive tools) under contracts that limit their use strictly to our operating instructions. We may disclose historical data to other third parties only where strictly required by statutory law or with your explicit consent.

6) International Transfers & Historical Fulfillment

We are a U.S. business. Where historical personal data relating to EU, EEA, or UK residents was transferred outside those regions for transactional fulfillment purposes prior to July 1, 2026, we relied upon appropriate legal frameworks—such as the EU Standard Contractual Clauses (2021/914) and the UK International Data Transfer Addendum—alongside supplementary digital encryption measures.

7) Retention

Because we no longer accept active sales from the EU or UK, we do not collect ongoing consumer data from these markets. Historical transactions, tax records, and order metadata are retained strictly for the duration of applicable statutory tax and accounting retention windows, after which they are permanently deleted or de-identified.

8) Your Rights (EU/UK Residents)

Past customers or casual visitors covered under the GDPR or UK GDPR retain their statutory privacy rights regarding their historical information:

  • Access, rectification, erasure, restriction, objection, and data portability.
  • Withdraw consent at any time (does not affect prior processing).
  • Lodge a complaint with your data protection authority (EU) or the ICO (UK).
  • Right to Complain: You have the right to complain directly to us regarding our data practices. We will acknowledge your complaint within 30 days and provide a full response without undue delay.

9) Cookies & Similar Technologies

10) Children

Our Services are intended strictly for individuals aged 18 and older. We do not knowingly collect personal data from anyone under 18. If we learn we have collected such data historically without appropriate consent, we will delete it promptly.

11) Representatives (Article 27)

EU: We do not currently appoint an EU representative under Article 27 GDPR because our historical processing is occasional, low-risk, and does not involve large-scale special-category sensitive data.

UK: We do not currently appoint a UK representative under Article 27 UK GDPR because our processing activities are limited, restricted to historical records, and do not involve special-category data.
